UM, ABOUT NEXT WEEK'S CRIMINAL LIST...

Thanks in large part to the ongoing Phelan trial, it looks as though next week's Criminal Term for Judge Howard F. Riley, Jr.'s "Rotation II" will be negatively affected. The cross-examination of the alleged victim by Thomas Edwin Phelan, who is acting pro se (not to mention, acting like a fool), finally ended shortly before 12:00 this afternoon. The cross-examination of the alleged victim began late yesterday morning and the Commonwealth still has at least 3 or 4 witnesses, including the detective who investigated the matter, to call to the stand. The good news is that it appears that Phelan may not call any witnesses; the bad news is that it's highly probably that when the detective is called to testify, the cross-examination may stretch into Monday.

Monday happens to be the start of the aforementioned "Rotation II" list, which is scheduled for one-week as opposed to the standard two weeks for a typical Criminal term. As it stands now, several pleas that were scheduled to be heard by Judge Riley were moved over to Judge Anthony Sarcione, who was in the middle of a miscellaneous list this week. During today's Call of the Criminal List for Rotation II, at least one trial was scheduled to be heard as part of the upcoming term, a rape out of Parkesburg and is slated to last 2-to-3 days. Like Phelan, Benjamin Henry Dorsey, Sr. is planning to represent himself during his trial.
