CLEARING A FEW MORE COMMON PLEAS CASES

Now that I've finally decided to stop procrastinating, it's time to recap a few cases that have cleared the Court of Common Pleas over the past few weeks.


And we start in Courtroom #4, where William Joseph Logan, 35, pled guilty to a summary charge of Disorderly Conduct following an incident in West Goshen. On January 21 at around 21:36, West Goshen police were dispatched to a residence on the 700 block of East Marhsall Street. Sgt. William Camlin and Ofc. Darren Sedlak from West Goshen and Ofc. Dave Stuart and Christopher Daly from WCPD arrived to find the defendant had broken into the victim's parked and unoccupied motor vehicle. Logan was found in possession of nearly $2.00 in change that was stolen from the vehicle, which belongs to a volunteer fire fighter. Logan was sentenced to 90 days probation and ordered to pay a $100 fine (CP-15-CR-0001261-2007). In June, Logan was given a similar sentence following a similar incident in December 23, 2006 incident that was investigated by Ofc. Brandon McGeehan (CP-15-CR-0001627-2007). Logan has a third case pending in front of Judge Nagle on similar charges filed by Ofc. Thomas Flick stemming from a January 2 incident; that case is slated for trial during Judge Nagle's text trial term in September (CP-15-CR-0001601-2007).

Paul Nicholas Onofrio, 24, of West Conshohocken, Montgomery County, pled guilty to a misdemeanor count of Disorderly Conduct following his role in the riot at Coyote Crossing earlier this year. On January 28 at 02:11, Ofc. Karl McIntyre was one of several officers from WCPD, West Goshen, Westtown-East Goshen, and other agencies dispatched to the notorious bar at Market and Matlack Streets after a co-defendant was fighting with bar staff and police. Onofrio was one of approximately 150 people who had congregated in the area as police were attempting to subdue the actor responsible for starting the mess. Onofrio had refused to comply with Ofc. McIntyre's order to disperse from the area and insisted on taking photos with his cellphone camera. Officers were forced to subdue Onofrio using pepper spray after he slapped Ofc. McIntyre's wrist while being placed under arrest. Onofrio was sentenced to one year probation and ordered to perform 25 hours of community service (CP-15-CR-0001190-2007).

The defendant at the center of the riot, Enun Ajong, is scheduled for trial next month in front of Judge Nagle on charges of Aggravated Assault, Simple Assault, Obstruction the Administration of Law or Other Governmental Function, Resisting Arrest, Disorderly Conduct, Public Drunkeness, and Possession of an Instrument of Crime (CP-15-CR-0001194-2007). The remaining four co-defendants in the case, John Edwin Candelas-Bush, 24, of Philadelphia (CP-15-CR-0001196-2007), Danielle Terri Foxwell, 24, of Media (CP-15-CR-0001199-2007), Heather Lynn Wills, 24, of Media (CP-15-CR-0001195-2007), and John Ianucci III, 26, of Philadelphia (CP-15-CR-00001198-2007) were all admitted into ARD and will be able to expunge their records if they comply with terms of the program.

Brian Jesus Camacho, 21, of West Chester, pled guilty to one count of Possession of a Controlled Substance With Intent to Deliver. On October 26, 2006 at 20:32, WCPD narcotics officers arrested Camacho at the Burger King at High and Price Streets on a bench warrant in an unrelated matter. In a search incident to arrest, Camacho was found in possession of powder and crack cocaine found in several bags. Also found on Camacho was what is commonly referred to as a "cut" - a non-controlled substance used to enhance the quality of the cocaine being sold. The defendant admitted to investigators that he had purchased the cocaine with the intent to re-sell it on the streets (CP-15-CR-0000101-2007).

The bench warrant leading to Camacho's arrest was relating to a theft of a firearm on the 500 block of South High Street five days earlier. In that incident, Camacho was alleged to have stolen the victim's car keys and removed a firearm from his vehicle. Camacho then allegedly sold the firearm to one Christian Oliveras (yes, that Christian Oliveras) in exchange for narcotics (CP-15-CR-0005052-2006).

Camacho had argued that both cases be dismissed for differing reasons. The drug charges, he argued, should've been dismissed, Camacho claimed, due to statements that he claimed were inadmissible due to police having no probable cause for the arrest. However, that part of his motion was denied, and eventually, Camacho was sentenced to 18-to-36 months in state prison on the PWID case. The theft and recieving stolen property case, however, was dismissed without prejudice due to the apparent unavailability of the alleged victim. That still means the defendant will begin his trip through the state prison system, thanks to the conviction.

In Courtroom #8, Paul Hally, 34, entered a no contest plea to Retail Theft after a January 31 incident at Rite Aid in which he took three camcorders valued at approximately $30.00 each. He was sentenced by Judge William P. Mahon to 1-to-23 months at CCP, ordered to attend Shoplifter's Classes, and undergo a drug and alcohol evaluation (CP-15-CR-0002107-2007). Hally was also sentenced on a parole violation relating to a 1999 domestic assault on his girlfriend), his 7th since he was originally sentenced on the case. He was committed to CCP for 15 months and 25 days (the balance of his probation term) with credit for time served while awaiting trial on the new charges (CP-15-CR-0002795-1999).

Stephen Gensel, 23, of West Chester, had two cases pending in front of Judge Mahon. In the first case, on December 21, 2006 at around 23:15, Ofc. Michael Meredith of the West Goshen Police was dispatched to the report of a shoplifter at the Lukoil at Paoli Pike & Turner Lane. Ofc. Meredith spotted Gensel walking on Paoli Pike towards West Chester and was found to be in possession of candy bars that weren't paid for and a carton of Newport cigarettes. Gensel admitted that he didn't pay for the items and was placed under arrest. While transporting Gensel to the police station, Ofc. Joseph Patro heard a plastic wrapper being crumpled and Gensel moving around in the back seat of the patrol car. Upon arrival at the station, Ofc. Patro found a Newport cigarette box with a shoe string, needle, and three packs containing a white powdered substance which later tested positive for cocaine (CP-15-CR-0000923-2007).

In the West Chester case, Sgt. Marty Deighan was on patrol on the 50 block of South Matlack Street when he responded to a property damage accident on February 22 at 15:03. Upon arrival, he made contact with Gensel, who had an active bench warrant out of Philadelphia. In a search incident to arrest, Sgt. Deighan recovered 3 blue wax-type packets containing an off-white in the defendants wallet. The suspected substances tested positive for .11 grams of heroin (CP-15-CR-0002181-2007).

Gensel was sentenced to 2 years consecutive probation to his probation violation on two counts of Forgery stemming from a November 11, 2005 incident in East Goshen, for which he was sentnced to 70 days (time served) to 23 months at CCP (CP-15-CR-0001933-2006).
