EAST SIDE CRIMINAL DAY - 6/15/07

A whopping 5 cases marked a relatively quick criminal day at 15-1-04 today. One case was continued to next week, one case was waived to Common Pleas Court, and a third case was continued pending compliance with an agreement in exchage for reduced charges. The other two cases saw full preliminary hearings.

In the first case, Alicia Lee Millbourne, 21, of West Chester faced charges of Theft by Unlawful Taking after being accused of stealing nearly $1,600 from the Spare Rib, where she had been employeed as a bartender. The owner of the bar alleged that Millbourne had stolen the money after discovering it was missing after closing time on April 6. The Commonwealth, however, failed to meet its burden of proof that Millbourne was the responsible party involved in the alleged theft and the case was dismissed. (15-1-04, CR-0000137-07)

In the second hearing, Anthony Mina, 27, of West Chester, was accused of Simple Assault after an incident in the early morning hours of April 1. At approximately 02:24, a witness testified that he was driving his car when he was stopped at the intersection of East Gay and North High Streets. While stopped at the traffic light, he observed Mina striking the victim with at least 7 punches at least one kick to the face. The witness testified that he was approximately 15 feet away from the assault when it occured. He then approached bouncers and a nearby bar, who in turn alerted police. The witness later picked out Mina from a photo array.

The alleged victim the testified that he and several friends were celebrating his birthday at Teca. The victim and his friends were planning to go over to one of their homes to continue the celebration. The next thing he remembered after leaving the bar was waking up at Chester County Hospital. The victim testified that he suffered multiple injuries to his face, but was unable to recall any details of the attack. He also testified that he had suffered from severe headaches, which he noted has since subsided.

The defendant was held on two counts of Simple Assault, and one count each of Harassment and Recklessly Endangering Another Person. He remains free on $1,000 bail. (15-1-04, CR-0000144-07)
