WEST SIDE CRIMINAL DAY - 7/17/2007

In a highly unusual circumstance - at least for this court - two preliminary hearings were held today at 15-1-01's Criminal Day, where recent weeks had seen no hearings held. The hearings highlighted a docket that included 18 cases listed...

In the first hearing, Christopher Falini, 36, of West Chester, was charged with Criminal Trespassing and Public Drunkeness following an incident on the 100 block of South Church Street last Thursday. Upon arriving on scene, Ofc. Christopher Daly observed a garage door propped open 1-to-2 feet with a green backpack. After Ofc. Daly and other officers surrounded the building, Falini crawled out of the garage. Falini was observed to have bloodshot eyes and a strong odor of alcohol from his breath. The victim, who is a distant relative of the defendant, was asleep when police arrived to inform her of the break-in. She had testified that the last time any items had been moved from the garage was 6 months ago and that Falini did not have permission to be in her garage at the time of the incident. She did indicate that the door was checked frequently, with the last time being the previous Tuesday. Falini was held for trial on all counts and had bail set at 10 percent of $2,500 (15-1-01, CR-0000186-07).

The second hearing involved a regular to the court system. Monte Albert Washington, 39, of West Chester, was arrested on July 5 during a ped stop on the 100 block of North New Street by Cpl. Josh Lee. Cpl. Lee testified that he had stopped Washington due to an active bench warrant lodged against him on an unrelated matter. During a search prior to being taken into custody, Washington allegedly was in possession of a glass pipe, a metal pipe, and a push rod in his left front pocket of his shorts and a small amount of suspected marijuana in a zipper pocket of his shorts. The drugs have not been sent to Lima as of yet, however preliminary tests indicated the amount was small enough to avoid more serious charges. Washington was held for trial on a single count of Possession of a Small Amount of Marijuana and Possession of Drug Paraphanalia. His bail in this case was set at $1.00 nominal bail, however the detainer made that a moot point (15-1-01, CR-0000185-07). Washington is slated to go to trial next month in front of Judge Mahon on separate drug possession charges (CP-15-CR-0000656-07) and is also scheduled to appear in front of Judge Knapp on Friday on yet another separate drug paraphanalia charge and driving under a suspended license (15-1-04, CR-0000170-07).

In a few other matters...

  • Albondio Avlisi, 55, of Coatesville was supposed to appear in court for a compliance hearing relating to drug possession charges. Having failed to appear for court, the charges were waived to Common Pleas Court (15-1-01, CR-0000061-07).
  • Peter Henry Sandeen, 19, of North Wales, Montgomery County, was scheduled for a complaince hearing on charges relating to possession of marijuana, possession of drug paraphanalia, theft from a motor vehicle, and disorderly conduct. Having failed to appear for court, the charges were waived to Common Pleas Court and a warrant issued for his arrest (15-1-01, CR-0000087-07).
  • Patrick Cunningham, 21, of Bensalem, Bucks County, had failed to appear for court in May on drug possession and paraphanalia charges; he surrendered to the court this morning, and was given a 2 month continuance on the charges as part of a summary agreement (15-1-01, CR-0000128-07).
  • Elliott Young, 18, of West Chester, was to have appeared on charges of Corruption of Minors, Conspiracy to Posess a Controlled Substance with Intent to Deliver, and related offenses last week, but failed to appear. This morning, he surrendered to WCPD and is now free after posting $2,500 bail; his preliminary hearing is scheduled for next Tuesday (15-1-01, CR-0000176-07).
