The first half of Judge Thomas Gavin's four week term (which is really split into two separate two week terms) ended on Friday with a couple of West Chester cases resolved:
Kevin Christian Devirgilis, 33, of West Chester, pled guilty to DUI/3rd Offense/2nd Tier and Endangering the Welfare of a Child after a road rage incident in West Goshen. On March 3 at 14:36, Ofc. Cheryl Taylor responded to the report of a property damage accident at Paoli Pike and Turner Lane. The victim was about to turn left onto Paoli Pike from Turner when Devirgilis' car struck his car, causing some scratches to the passenger side. Devirgils then spit into the victim's vehicle before driving off. Devirgilis' 4-year-old daughter was in the car at the time. He later pulled into the Wawa on Gay Street. Upon arrival, Ofc. Taylor observed signs of intoxication and that Devirgilis was having a tough time maintaining his balance. He was transported to CCH for a blood draw; the blood test resulted in a .12 BAC.
Judge Gavin sentenced Devirgilis to 90 days to 23 months at Chester County Prison, one year consecutive probation, fined $1,600 ($1,500 on the DUI and $100 for the Recklessly Endangering Another Person, ordered to pay the $70 Lima Lab fee, perform 100 hours of community service, and will suffer an 18 month driver's license suspension (CP-15-CR-0002371-2007)...
Vincent Daniel Friedel, 45, of Malvern, was charged with Simple Assault and Harassment following a New Year's Eve domestic fight. At 10:45, Ofc. Aaron Davis was dispatched to a residence on the 900 block of Cloud Drive in East Bradford for the report of a domestic dispute reported physical. The victim (the defendant's wife) stated that Friedel threw a plastic baby bottle at her, striking her in the face during what she described as a verbal dispute. As a result of a plea bargain, Friedel pled guilty to a summary charge of harassment and sentenced to 90 days probation and ordered not to have contact with the victim (CP-15-CR-0000857-2007)...
Most of the other West Chester related cases in front of Judge Gavin were passed to next week or continued to the next term. The second half of Judge Gavin's criminal term will start next Monday.
Also, today marked the start of Judge Anthony Sarcione's "Rotation II" criminal list, although a lot of pleas slated to be heard by him were moved to other judges (a few were moved to Judge Nagle's court) due to the ongoing Michael Sheller murder trial (and no, I haven't been covering it because Jen Miller is doing a good job covering it for the DLN, and for me to cover the same trial would be a little redundant). That trial is expected to go to the jury either tomorrow or Wednesday.
Tomorrow is Judge Bruno's Criminal Day at 15-1-01; also, because of a scheduling quirk, Judge Bruno is also the on-call District Judge tonight (filling the slot that would normally be assigned to Goshen District Court; however since Senior District Judge Susann Welsh is presiding at Goshen, on-call days assigned to Goshen are re-assigned to other judges; Coatesville District Judge Robert Davis filled in on Saturday and Sunday). I might miss the first part of the first quarter of tonight's Iggles game to see if anything interesting happens in the first hour of on-call at Judge Bruno's court, though I will definiately be there for Criminal Day tomorrow, even if the Iggles somehow find a way to screw tonight up and lose to the Prince George's County (Md.) Indigenous Persons...

A COUPLE OF COMMON PLEAS QUICKIES...
There was very little worth reporting on this past week in Common Pleas Court, but there were two very interesting incidents that took place...
At around 13:30 Tuesday afternoon, a woman in her 20's was spotted laying on a bench at Gay and Church Streets adjacent to the Court House. This wouldn't be too newsworthy except for the fact that (1) the woman was wearing a slip as opposed to a dress, (2) she was positioned in a way that an unsavory male might have, shall we say, tried to take advantage of her, and (3) she was unresponsive despite attempts by several people to wake her up. Hence, a couple calls to 9-1-1 later, no fewer than four sheriff's deputies and WCPD P/O David Frantz arrived on scene while GFAC and Medic 91 were dispatched to assist the victim. EMT's were able to revive the woman, who appeared to be intoxicated either on alcohol, drugs, or both and clearly had no idea where she was or where her kids were. The woman was transported by GFAC to Chester County Hospital; there's no word as to whether her nomination for "Mother of the Year" has been rescinded...
Meanwhile, in matters inside the Court House, the lone case of local interest was heard in front of Judge Riley on Thursday morning. Chad Allen Sprenkle, 35, of Birdsboro, Berks County, pled guilty to one count of Invasion of Privacy/Criminal Attempt following an incident at the Chester County Book Company at the West Goshen Shopping Center on February 19. On that day, Sprenkle was doing construction work for a contractor when he was discovered in a room adjacent to a women's restroom. According to the criminal complaint, Sprenkle was spotted bending over to look through a hole into the restroom in what could be described as voyeruism at its worst. Sprenkle admitted that he was a sex addict and had commited his crime to satisfy urges that most rational persons would consider perverted.
As part of a plea agreement, he was sentenced to 2 years probation, ordered to undergo a mental health evaluation and a sex offender's evaluation, was barred from the store's property, and ordered to allow the probation department access to computers at his home or at any other location he would have access to a computer. (CP-15-CR-0001799-2007)
Meanwhile, a scheduled violation of probation hearing involving a real "winner" from Exton was continued until July 27 due to the alleged violator's inability to obtain counsel. It's too bad the hearing was continued, because this particular defendant's track record makes for some interesting fodder. However, since the matter was continued, I'm going to hold off on the particulars for now...
Now that the 4th of July holiday has passed, next week at Common Pleas Court should bring some very interesting cases, including a defendant who has treated the court system like a revolving door since the Reagan administration. That and a few other cases will be brought up over the course of the next week...

POLICE ACTIVITY ON GOSHEN ROAD
Multiple police agencies were active last night on Goshen Road in West Goshen, though details are very limited as I only caught bits and pieces towards the end of the incident over my scanner. It sounded like there was either a drug raid or standoff in the area, as mention was made of windows being damaged by flash bang grenades. I am more inclinded to believe this was a stand-off, as there was a request over police radio to have the FCC restrict air-space over the scene, which is usually a good indication that it was a standoff. More than likely, details will come out either in today's or tomorrow's paper...

GOSHEN CRIMINAL DAY x2 - 6/14/07 & 6/21/07
Now that I've finally caught up with the "priority stuff" (the Criminal Days in the borough and some outstanding Common Pleas Court stuff), it's time to expand the world of this blog by adding Goshen District Court (15-2-03), which covers Thornbury, West Goshen, and Westtown, to the list of Criminal Days that will be covered by this site. Here now is coverage of the past two Criminal Days from Goshen.
On June 14, Flag Day, only one preliminary hearing took place in front of Senior District Judge Susann Welsh, who is presiding over 15-2-03 after the retirement of District Judge J. Peter Winthur, whose seat will be filled at election this November. The lone case to come out of the Flag Day hearing was the Commonwealth vs. Michael Tillman, 39, of West Chester, who was charged with DUI, Accident Involving Damage to an Attended Vehicle, and Careless Driving. (15-2-03, CR-0000130-07)
At the hearing, the victim testified that at 15:07 on April 13, she and two passengers were en route to the Phillies game that night when she was stopped at the traffic light on 202 at Matlack Street. Her car was then rear-ended by a Hummer. The driver of the Hummer then allegedly fled the scene on South Matlack, heading into the borough. Another person called the 9-1-1 center to report the incident, while the victim began to follow the defendant, eventually leading to a nearby apartment complex.
P/O Wesley Holman of the West Goshen Police Department then testified that upon recieving a report of the incident from dispatch, he responded to the parking lot of the West Chester Commons apartment complex at Rosedale and Matlack. He later tracked down the Hummer in question at the South Campus Aparment complex on the WCU campus. P/O Holman saw the vehicle driving about 6-to-8 feet towards him, at which point he parked his patrol car at an angle and ordered the defendant out of his car at gunpoint, assisted by Sgt. Robert Herzog of WCU Police.
Once Tillman was out of his vehicle, P/O Holman observed that the defendant had bloodshot eyes, slurred speech, and had fallen several times. At that point, Tillman was transported to CCH for blood testing to determine his intoxication level. The tests revealed that Tillman's BAC was .284, four times the legal limit for intoxication.
Based on the evidence presented, Judge Welsh held Tillman for trial on all counts; he remains free on $1,000 unsecured bail.
Of the remaining 9 cases listed, six defendants waived preliminary hearings, one case was withdrawn following compliance with an agreement, and the other two cases were continued...
This past Thursday's Criminal Day at Goshen proved to be more active than the previous week's. Of the 16 cases listed, 3 defendants had preliminary hearings, 2 defendants failed to appear for court, 5 cases were waived to Common Pleas Court, 1 case was withdrawn, and the remaining 5 were continued. All three of the hearings were DUI-related...
The first hearing was the matter of Commonwealth vs. Jeffrey Spano (15-2-03, CR-0000159-07). Spano, 28, of West Chester, faced charges of DUI and speeding stemming from a traffic stop performed by Sgt. William Camlin of the WGPD. Sgt. Camlin testified that he was on a traffic post on the 800 block of West Chester Pike at around 23:52 on May 7 when he observed a white Chevrolet SUV heading eastbound on the Pike travelling 61 mph in a 35 mph zone. Spano was stopped 3 blocks east of Sgt. Camlin's traffic post, where he administered four field sobriety tests and was taken to CCH for blood work. The defendant's BAC was determined to be .15, slightly less than twice the legal limit. The defendant was held for trial on all counts, and remains free on his own recognisance...
In the second hearing, Commonwealth vs. David Kilgore (15-2-03, CR-0000156-07), P/O John Liss of WGPD testified that he was dispatched to the report of a car vs. building MVA on the 100 block of North Five Points with unknown injuries. Upon arrival, P/O Liss saw a Ford Ranger which had struck the "M" building of the apartment complex, with the vehicle running and Kilgore allegedly inside the vehicle. He saw two empty beer cans in the center console of the truck and on the floor of the vehicle, with more beer behind the driver's seat. The defendant allegedly attempted to drive off before he was removed from the truck and placed under arrest. According to a report from the PSP Lima labs, Kilgore's BAC was reported to be .24. P/O Liss testified that he was unable to locate any other occupants or potential victims nearby. Kilgore was held on all charges, and remains free on $5,000 unsecured bail.
The final hearing was towards the end of the session, as the matter of Commonwealth vs. Christopher Harper (15-2-03, CR-0000269-06) was heard. Harper faced charges of DUI, Possession of Drug Paraphanalia, Driving Under a Suspended License, and Careless Driving. During his hearing, P/O Brian Griesser was dispatched to an MVA reported serious on US 202 southbound in the area of the 322 bypass. Upon arrival, P/O Griesser saw a Ford Fusion with moderate damage after striking a dirt embankment. He allegedly saw the defendant behind the wheel of the car, where he was unresponsive upon the officer's arrival.
P/O Griesser then testified that he saw an open cigarette pack containing 2 syringes in plain view, located in the driver's side door. Harper was removed from the vehicle by GFAC and Medic 91 and was transported to CCH. Harper reportedly became more responsive once he was in the ambulance, where he allegedly told the EMS personnel that he was under the influence of cocaine, which was later confirmed by the blood work taken following the accident. It was later determined that the vehicle Harper was allegedly driving was a rental car reported missing, though no charges were reportedly filed in that matter.
Harper was held on all counts; bail in this matter had been set at $500, however Harper is presently serving a 11 1/2-to-23 month jail term at Berks County Prison after pleading guilty to a count of Theft by Unlawful Taking from an incident in Robeson Twp on September 21, 2006 (CP-06-CR-0005004-2006).

WEST SIDE CRIMINAL DAY - 5/15/07
True to form, Tuesday's Criminal Day at 15-1-01 was very slow, with not even one single preliminary hearing. Of the 8 cases listed on the docket, two were continued, 4 defendants waived their preliminary hearings, and the remaining two charges reduced. The lone highlight was the arraignment of a 25-year-old East Goshen man on assault and robbery charges.
Corey Ashton Barr was arrested Monday night by West Goshen Police on 19 separate counts, including - 3 counts of Possession of a Controlled Substance, 2 counts of Robbery, 2 counts of Harassment, 2 counts of Disorderly Conduct, and 1 count each of Aggravated Assault, Terroristic Threats, Theft from a Motor Vehicle, Reckless Endangerment, Loitering/Prowling, Simple Assault, Possession of a Weapon, Possession of an Instrument of Crime, Theft by Unlawful Taking and Receiving Stolen Property. He was committed to Chester County Prision in lieu of $10,000 bail and is scheduled for a preliminary hearing next Thursday at District Court 15-2-03 in West Goshen in front of Senior MJD Susan Welch (former Honey Brook District Judge); who is presiding over 15-2-03 after the recent retirement of J. Peter Winther.
At the time of his arrest, Barr was on probation for several theft offenses in a case out of West Whiteland. He had faced 13 counts of Recieving Stolen Property, 10 counts each of Theft by Unlawful Taking and Prowling, and 5 counts of Criminal Mischief (15-2-07; CR-0000037-06); he had pled guilty to 2 counts of Theft and was given time served to 23 months in jail, plus 2 years probation post-release (CP-15-CR-0002153-2006).
I guess old habits (allegedly) die hard...

CHILD STRUCK ON GAY STREET
At around 17:20, GFAC and Medic 91 were dispatched to the report of a male juvenile who was struck on Gay St in front of the Wawa in West Goshen. Upon arrival, EMS requested a direct fly for the 9-year-old male who suffered a loss of consiousness after being struck by a vehicle and thrown approximately 30-35 feet. The victim was flown to Children's Hospital of Philadelphia by PennSTAR #2. It's not known whether this was a hit-and-run or not, but it didn't appear to be the case. West Goshen police are handling the investigation.
