Now, some cases from Judge Anthony Sarcione's "Rotation I" list that were recently adjudicated:
Two Southern Chester County men pled guilty to their roles in a May 15 pursuit into West Goshen after they broke into a parked vehicle on the East End of West Chester. Jose Sanchez Garcia, 28, of West Grove, pled guilty to one count of Conspiracy to Commit Theft by Unlawful Taking and one count of Conspiracy to Commit Criminal Mischief. As part of a plea agreement, he was sentenced to 2 years probation, fined $50, and ordered to pay $2,335 total restitution to his victim (CP-15-CR-0002183-2007). Jose Gonzalez Vega, 22, of Avondale, also pled guilty to similar charges in front of Judge James MacElree II (who had heard some of Judge Sarcione's pleas while he was in trial). As part of his plea agreement, Gonzalez Vega was sentenced to 119 days to 23 months at Chester County Prison, fined $50, and ordered to pay the same amount of restitution to the victim (CP-15-CR-0002173-2007).
Mallory E. Haldeman, 21, of West Chester, pled guilty to a 1st Offense/3rd Tier DUI following a early spring traffic stop. On May 3 at 22:51, Cpl. Pam Baumann spotted the defendant's car emerging rapidly from a parking spot, narrowly missing several parked cars along the east side of the 500 block of South Walnut Street. Cpl. Baumann observed Haldeman making a right turn off of Walnut onto Market Street, where such turns are probhibited. The vehicle was then pulled over on the 400 block of East Market Street where, after failing 3 field sobriety tests, Haldeman was arrested and taken to Chester County Hospital for a blood draw. Her BAC at the time of the arrest was .21. She was sentenced to 5 days to 6 months at CCP, fined $1,000, and ordered to pay the $70 Lima Lab fee (CP-15-CR-0002661-2007).
Charles Robert Sims, 22, of Upper Darby, pled guilty to possessing prescription pills following a pedestrian stop Uptown. On March 11 at 01:38, Ofc. Aaron Davis spotted the defendant asleep against a building along the 50 block of North High Street. Ofc. Davis observed that the defendant was unsteady on his feet, had slurred speech, and also detected an odor of alcohol on his breath. He was then arrested for Public Drunkeness. In a search incident to arrest, Ofc. Davis found three pills which later tested positive for percocet, of which Sims was not prescribed to have. As part of his plea agreement, Sims pled guilty to one count of Possession of a Controlled Substance and was sentenced to 1 year probation, fined $100, and ordered to pay the $105 Lima Lab fee (CP-15-CR-0002800-2007). At the time of his arrest, Sims was in the ARD program in Delaware County on charges of Access Device Fraud, Receiving Stolen Property, and Retail Theft following a May 14, 2005 arrest in Radnor; Sims was since removed from ARD and is scheduled for trial in Delaware County on October 22 (CP-23-CR-0004701-2006).
Muhammed Husain Abdul-Wakil, 23, of Elkins Park, Montgomery County, finally answered to theft charges following a 2002 theft from two women's purses. He was sentenced to 1 year probation and ordered to pay $100 in restitution to his victims (CP-15-CR-0005772-2003). Wakil was declared a fugitive in 2003 after failing to respond to the charges. Abdul-Wakil was in Montgomery County Prison facing Forgery charges from an incident in Jenkintown. On August 8, Abdul-Wakil pled guilty on one felony count of Forgery and remanded to Montgomery County Prison to await sentencing; a quick glance at court records indicate that Abdul-Wakil was, as part of his plea agreement, sentenced to 4 years probation, with formal sentencing scheduled for August 8 (CP-46-CR-0002862-2007).
