Preliminary hearings for two narcotic investigations and an indecent assault case capped a relatively quick criminal day session at 15-1-04 today. Of the 13 hearings listed on the docket, three defendants waived their preliminary hearings, four had charges reduced to summary offenses (keeping them out of Common Pleas Court), and three defendants continuances to later dates.
In the first hearing, a 21-year-old borough man faced charges that he allegedly sold crack cocaine to a confidential informant who was assisting the State Police. During the hearing, the undercover trooper testified that on three separate occasions last year - March 24, March 31, and April 18 - Christian M. Oliveras sold 13.4 grams, 13.2 grams, and 14.0 grams respectively to the informant from both his residence on the 300 block of South Adams and from behind a building off of a nearby alley. The trooper testified that in all three cases, the substances tested positive for crack cocaine according to the State Police lab at Lima. Oliveras was held for trail in Common Pleas Court on three counts each of Manufacturing/Delivery/Possession with Intent to Distribute, Possession of a Controlled Substance, and Possession of Drug Paraphanalia, along with one count each of Criminal Use of a Communication Facility and Underage Drinking. He remains free on $50,000 cash bail. (15-1-04; CR-0000127-07)
In the day's second hearing, a 53-year-old Lancaster County man stood accused of fondling a patient at a local assisted living facility. Steven J. Gall allegedly fondled a female stroke victim and made both verbal and physical sexual propostions of the victim, who rejected his advances. Moments later, Gall allegedly left the scene of the incident in his truck. The victim had testified that she had no prior interactions with the defendant. Gall was held for trail in Common Pleas Court on one count of Indecent Assault without Consent of Another and remains free on $5,000 unsecured bail. (15-1-04; CR-0000108-07)
The final hearing, also a drug case, a 22-year-old borough man faced charges that he sold rack out of the Union Court Apartment complex. Markus Allen Thomas allegedly sold approximate one gram of cocaine to a confidential informant on three separate occasions - on September 5, 13, and 20 - according to testimony from detectives from the County's CID and the Chester County Municipal Drug Task Force. In all three cases, the tests from the Lima lab came back positive for cocaine. Thomas was held on three counts each of Possession of a Controlled Substance with Intent to Distribute, Possession of a Controlled Substance, Possession of Drug Paraphanalia, and Criminal Use of a Communication Facility.
